In-Field Workshops

Cancellation Policy

Planning and scheduling workshops require a significant amount of time and effort, but we also understand life happens and plans may be forced to change. To be fair to all involved parties, the following refund schedule applies to all workshops unless noted otherwise:

More than 120 days (4 months) prior to the scheduled start date: 100% refund
Between 90 and 30 days prior to the scheduled start date: 50% refund
Less than 30 days prior to the scheduled start date: No refunds granted

All refunds will be made by the same method as the original payment.

These terms may not apply for some workshops, due to their nature and/or non-refundable associated costs, and refunds of any payments will not be offered under any circumstances. Such exceptions to this cancellation policy will always be noted in the workshop description.

Liability

By attending a workshop with Michael Rung Photography, LLC you are accepting certain risks. Your application and payment (whether deposit or full amount) shall serve as a release of our liability and a complete assumption of all risks by you and your heirs, administrator, executor, successors, and assignees for all family members.

By accepting these terms and conditions, you are acknowledging that you are aware that travel, wherever it may be and by whatever means, involves some inherent risk of injury, illness, death, loss, or damage to personal property, which may be caused by acts of nature, negligence, or acts of others.

In consideration of, and as part of the payment for your participation in a program, workshop, excursion, expeditions, other activities, or any program that Michael Rung Photography, LLC, or their assigns, may be conducting, you are voluntarily releasing Michael Rung Photography, LLC, their employees, assigns, independent contractors or anyone involved thereof, from any damages, liabilities, costs, injuries whether mental or physical, known or unknown, and by participation, you agree to assume all risks whether known or unknown. You acknowledge voluntarily that by traveling to areas that may be remote, foreign, mountainous, wilderness, wild rivers, remote deserts, and may not be maintained to the standards you are accustomed and therefore may involve certain additional risks, dangers, and inconveniences including, but not limited to, terrorism, forces of nature, wild animals, hotel accommodations, airplane, vehicles, trains, boats, roads, walkways, trails, and other means of conveyance or other unknown risks. You acknowledge that medical services and facilities may not be readily available during all or part of the trip, including medical care, the presence of physicians, and medication. We assume no liability for medical care. We assume no liability for dietary requirements you have.

Every participant must assess their own suitability, in terms of fitness and stamina, for the workshop that they join. Medical equipment, photography equipment and travel insurance is your own responsibility. You must notify us of any medical condition that we should know about. We assume no liability regarding provision of medical care. Please note that all your information is completely confidential.

We shall have no responsibility for additional expenses incurred due to unforeseen delays caused by weather, theft or criminal activity of any kind, political disputes, acts of terrorism, strikes, sickness, failure of flights or other transportation to arrive or depart on time, and other causes beyond our control. We are not responsible for additional accommodation not specified in the workshop itinerary which may be required en route, prior to or following a trip, caused by airline scheduling or schedule changes, or by individual clients’ travel arrangements or by other factors. We cannot assume any responsibility for loss or damage to baggage or personal property.

In no event shall we have any liability for incidental or consequential damages, however characterized.

Health and Fitness

You have assumed the responsibility to select an activity/workshop appropriate to your physical abilities and interests. You are personally responsible for being in sufficiently good health to undertake the associated activity. By accepting our terms of service, and by your payment (deposit or in full), you certify that you do not knowingly have any physical or other considerations of disability that would create a risk for you or other participants. Also, you authorize Michael Rung Photography, LLC and/or its associates, to initiate and offer medical care in the event of a medical emergency. We reserve the right to request a doctor’s statement of good health. If, after reasonable accommodations of your physical abilities have been made, it is determined by the trip leader that your continued participation in the workshop would negatively affect the rest of the group’s activities, you can be removed from the workshop, and it is agreed that no refunds will be issued in such circumstances. Any expenses associated with you leaving the workshop are yours and yours alone. We also reserve the right to determine your fitness for a trip based on new information you provide to us before a trip.

Workshop Cancellations or Changes

While Michael Rung Photography, LLC will make every attempt to operate a trip once confirmed, we do reserve the right to cancel or change a trip, at any time due to insufficient bookings and/or reasons beyond our control that might create unsafe or undesirable travel conditions for the participants. In such case, a full and immediate refund will be issued.

However, the financial liability of Michael Rung Photography, LLC shall be limited to the amount paid to Michael Rung Photography, LLC for the workshop only and shall not be extended to cover any other associated travel costs incurred (e.g. non-refundable air tickets, visa fees if applicable, clothing, equipment, miscellaneous transportation costs, medical expenses, travel insurance premiums, etc.). We reserve the right to refuse acceptance of any participant, for any reason, at any time. We are not responsible for any additional expenses incurred by such participants.

All participants acknowledge that nature photography is subject to many variables including but not limited to environmental conditions that cannot be guaranteed.

Use of Name and Likeness

We reserve the right to take photographs or videos during the operation of any workshop or part thereof and to use the resulting photography in whole or in part for promotional purposes, including, but not limited to: advertising and publicity both in print and electronic media. By booking a workshop with Michael Rung Photography, LLC, participants agree to allow their images to be used in such photography; participants who prefer that their image not be used are asked to identify themselves at the commencement of their trip. We also reserve the right to use, in all or in part, any written reviews or behind-the-scenes photos you may provide to us in our advertising and publicity both in print and electronic media.

Insurance

We strongly recommend that you purchase insurance/travel insurance, including coverage for the damage or loss of your equipment while on a workshop, your personal health, emergency medical evacuation, emergency medical expenses, and trip cancellation, which would reimburse you for non-refundable airfare and trip cancellation fees. We cannot accept liability for insurance costs, loss of deposits, airline cancellations or delays or penalties incurred by the purchase of non-refundable airline tickets or other expenses incurred by participants in preparing for this workshop. Such insurance often provides coverage for losses suffered in the event of trip cancellation and interruption, travel delay, loss of baggage and travel documents, baggage delay, medical emergencies, and accidental death. We cannot accept liability for any insurance costs if a workshop is cancelled.

Not Included in Workshop Fees

Transportation and related fees (except as indicated in the itinerary); activities noted as optional in the itinerary; gratuities, unless otherwise noted on the itinerary page; passport and visa expenses; baggage/accident/cancellation insurance; personal expenses, such as laundry, telephone calls, meals (except as indicated on the itinerary) alcoholic beverages; and any other items not specifically noted as included.
